On the 23rd day of April, 1917, Merring, Martin & Boise Company, as plaintiff, commenced an action in the district court of Jackson county against H. Lieberman, as defendant, to recover the balance due upon a carload of eggs alleged to have been sold by the plaintiff to the defendant for the sum of $3,742.30, which were shipped from Weatherford, Tex., to Chicago, Ill.; alleging that on the defendant’s failure to accept and pay for the same the eggs were resold by direction of the plan tiff in the open market at Chicago at public auction after five days’ notice of such sale, and the net sum…
