COLEMAN, Justice.

This is a suit by appellee on a contract, by the terms of which he was employed by appellant as Director of Agencies, to recover commissions on renewal premiums, paid, and to be paid in the future, on policies of insurance issued by appellant during the period of employment.

The principal question involved is whether appellant’s point on appeal complaining of the action of the trial court in rendering judgment for appellee for the present value of commissions, which under the terms of the contract were payable when collected, can be considered in the absence of a motion for…
