Irby C. Walker was in the employ of the Pinkerton National Detective Agency. Walker, as a detective, had been assigned by his employer to service in a jewelry store during the Christmas holidays in the City of Atlanta. It was Walker’s duty *93to watch the store for the purpose of discovering any one who might unlawfully molest anything in the store.
