This cause is before us on petition granted on January 10, 1952, pursuant to the provisions of the' Uniform Code of Military Justice, Article 67(b)(3), 50 USC § 654. The accused, Jarvis, was tried in Korea by general court-martial for the unpremeditated murder of one Jong Ku Suop, a Korean national, in violation of Article of War 92, 10 USC § 1564. Following his plea of not guilty, he was found guilty, and sentenced to dishonorable discharge, total forfeitures, and confinement at hard labor for life.
