Plaintiff Joseph D. McDonald (“plaintiff’ or “McDonald”) brings this action 1 against the City of New York and the New York City Department of Transportation (“DOT”) (together, “defendants”) alleging employment discrimination and retaliation on the basis of his disability in violation of the Americans with Disabilities Act, as amended, 42 U.S.C. §§ 12101 et seq.
