David Shearon (“Plaintiff’) commenced this action against his former employer, Comfort Tech Mechanical Co. (“CTM” or “Defendant”), on January 9, 2012, alleging three causes of action for disability discrimination in violation of (1) the Americans with Disabilities Act (“ADA”), 42 U.S.C. § 12101; (2) the New York State Human Rights Law (“NYHRL”), N.Y.
