This contract case is before the court after argument on cross-motions for summary judgment. After defendant obtained summary judgment on this claim, plaintiff succeeded in reopening proceedings, and the pending dispositive motions followed. Prompted by the Government’s admission that the subject state tax for which the contractor seeks refund was not included in the Government-supplied price that the contractor utilized in its proposal, plaintiff seeks judgment in its favor.
