MEMORANDUM AND ORDER

HERBERT F. MURRAY, District Judge.

Presently pending before this Court is defendants’ motion, pursuant to Fed.R. Civ.P. 12(b)(6), to dismiss plaintiff’s complaint on the ground that it fails to state a claim upon which relief can be granted. Memoranda in support of and in opposition to this motion have been filed by the parties and considered by the Court. A hearing on this motion was held before the Court on February 17, 1984. For the reasons stated herein, defendants’ motion to dismiss will be granted. In light of this dismissal, it is not necessary to consider…
