MEMORANDUM

NORTHROP, Senior District Judge.

Pending before the Court is Defendants’ Motion to Dismiss (Paper No. 5). This motion is opposed (Paper No. 6). After a review of all briefs filed and in consideration of the arguments presented by counsel at hearing, the Court will grant in part and deny in part Defendants’ Motion to Dismiss.

More specifically, the Court will deny Defendants’ motion to dismiss the Constitutional violations alleged in Counts I and II under the equal protection and substantive due process clauses of the Fourteenth Amendment. The Court also will deny Defendants’ motion to…
