In these two civil rights actions, Plaintiffs Jeffrey Deskovic (“Deskovic”) and his mother, Linda McGarr (“McGarr”) (together, “Plaintiffs”), bring claims against the City of Peekskill and a number of police officers and other officials, in connection with the wrongful arrest, conviction, and incarceration of Deskovic.1 Deskovic brings claims under 42 U.S.C. § 1983 (“Section 1983”) for numerous violations of his constitutional rights and under state law for malicious prosecution as well as negligent and intentional infliction of emotional…
