This is an action for libel. In the early part of 1901 plaintiff was a member of the firm of A. C. Dauphiny & Company, doing a general merchandise business in the city of Eureka, and both he and defendant were members of the common council of said city. At that time there was presented to the council petitions by various railroad companies for franchises to operate their roads across the city front of the city.
