This cause came on to be heard upon an appeal from the Court of Common Pleas of Warren County, Ohio.
On October 6, 1982, the Warren County Grand Jury indicted defendant-appellant, Isaac Madden, on four counts of rape in violation of R.C. 2907.02 (A)(3). The indictment stated that the violation set forth in count one occurred during a time span ranging from June 1, 1981, thru December 31, 1981.
