This is an action on an insurance policy issued by the defendant company through its Union and Stanly branch, covering several houses and contents belonging to the plaintiff, including his dwelling, for the amount of $300. The total insurance was nine hundred dollars. The defendant was incorporated by Chapter '343, Private Laws of 1893, and amended by Chapter 15, Laws of 1895. It was provided by the charter that the insurance business of the Association should be conducted by and through branches thereof, which should consist of fifty or more persons.
