EVERETT, Chief Judge:

A general court-martial sitting at Bremerhaven, Federal Republic of Germany, and consisting of a military judge alone tried appellant on charges that on March 29, 1981, he had carnally known his adopted daughter, Melissa, and had attempted to commit sodomy with her, in violation of Articles 120 and 80, Uniform Code of Military Justice, 10 U.S.C. §§ 920 and 880, respectively.
