The principal question presented by this appeal is whether in an action for damages delay in conveying real property the measure of damages is controlled by Civil Code, section 3306.

Plaintiff-respondent is a licensed building contractor engaged in the business of building homes for speculation. By a “Deposit Receipt” agreement dated May 24, 1954, appellants agreed to sell and respondent to buy 30 lots in a subdivision being developed by appellants in Santa Clara County.
