MEMORANDUM OPINION AND ORDER

GRAHAM, District Judge.

Plaintiff John K. Lafferty sustained serious personal injuries as a result of a motor vehicle collision which occurred on December 4, 1996 in Franklin County, Ohio. At the time of the accident, Lafferty was operating a 1992 GMC pickup truck belonging to his employer, Consolidated Rail Corporation (“ConRail”), when a 1994 pickup being operated by Ian D.
