Tbis was a proceeding in garnishment brought by the Oklahoma National bank, as plaintiff below, against Williamson, as garnishee, and Dowden. On August 13, 1895, the Oklahoma National bank brought suit against E. W. Dowden, in the district court of Oklahoma county, to recover judgment on a promissory note for $2844.30, executed by Dowden, September 11, 1894, and due March 11, 1895, with interest. The errors assigned were argued in the-brief of the plaintiff in error, in the first place, upon the-proposition -that the court had no power under the-evidence, to instruct the jury that they might return a money judgment, nor to enter up the judgment after the-verdict, for a specified amount of damages, and that it-had no power to enter up the judgment upon such a verdict. '
