This matter comes before the Court on plaintiffs’ Motion for Class Certification. In March of 1985, plaintiff Manuel Rodriguez brought suit against the Department of the Treasury, alleging that the Uniformed Division (“U.D.”) of the Secret Service discriminated against him and others similarly situated by rejecting or discouraging the application for employment by recovered asthmatics.
