Morrison, C. J.:

The following is a statement of the facts presented by this case : In 1867 a suit of partition was brought by Emeric against Alvarado et al., in the Fifteenth District Court, and such suit was prosecuted down to July 15th, 1878, at which time an interlocutory decree was entered, and three referees were appointed to make partition of the land in controversy.
