OPINION
LYDON, Senior Judge.
This is an action seeking just compensation under the Fifth Amendment to the United States Constitution for an alleged taking of property. Plaintiff asserts that under the Telecommunications Act of 1996, Public Law. No. 104-104, 110 Stat. 56, amending the Communications Act of 1934 and codified at 47 U.S.C. § 151, et seq., as implemented by the Federal Communications Commission and applied by the Colorado Public Utilities Commission, it was required to provide certain of its property to its competitors, for an open-ended time period, at less than fair value.…
