Petitioner, William Voigt, Jr., has made application to this court for a writ of habeas corpus to obtain his release from imprisonment in the state penitentiary, or, in the alternative, to obtain an order modifying the judgment, sentence, and commitment rendered by the superior court for Cowlitz county in a former criminal action wherein petitioner had been convicted of the crime of murder in the first degree. Coincident with his application, and ancillary thereto, petitioner also presented to this court, in a separate proceeding, a petition for the issuance of a writ of certiorari directed…
