Appellant was charged with the crime of keeping open a drinking saloon on Sunday. The complaint was. filed before a justice of the peace in and for Walla Walla precinct, Walla Walla county. A trial was had before a jury, resulting in a verdict of guilty, but the jury did not by its verdict assess any punishment. Thereupon the justice assessed a fine of $99, and gave judgment that appellant should pay said sum and the costs of the action, and, in default of payment, should be committed to the county jail.
