STEELMAN, Judge.

Plaintiff Lynetta Draughon, the personal representative of the Estate of Max Draughon, appeals from an order dismissing plaintiffs claims against defendant Honeycutt with prejudice. For the reasons discussed herein, we affirm.

Plaintiffs intestate was a football player at Triton High School in Harnett County, North Carolina. He collapsed during football practice on the morning of 8 August 1998 and died the following day at UNC Memorial Hospital from complications due to heatstroke.
