On 3 November 2009, Dale Ronald Stunzi (“plaintiff’) filed a complaint against defendants Medlin Motors, Inc. (“Medlin”) and Western Surety Company 1 alleging claims of breach of the North Carolina New Vehicles Warranties Act, violation of the Truth in Lending Act, breach of the duty of good faith, unfair and deceptive trade practices, breach of contract, fraud, and punitive damages, all arising from plaintiff’s purchase of a 2003 Hyundai Tiburón motor vehicle from Medlin on or about 7 August 2004.
