MITCHELL, Justice.

This is an action involving interpretation of the statutory time periods for service of process under the North Carolina Rules of Civil Procedure. Specifically, we must decide in this case whether the Court of Appeals erred in affirming the trial court’s order that denied the plaintiffs motion for an extension of time to serve an alias summons and dismissed the action. The trial court’s order was based upon its conclusion that, as a matter of law, it was without authority to grant the plaintiffs motion for an extension of time under N.C.G.S. § 1A-1, Rule 6(b) to serve an…
