Plaintiff seeks recovery from defendant as surety on a bond. Upon hearing before the circuit court without a jury, judgment was entered for defendant. Plaintiff has appealed.
The plaintiff is the warden of the Michigan reformatory at Ionia, and the bond in suit runs to “the State prison commission for the use and benefit of the Michigan reformatory at Ionia, Michigan.’’ The reformatory manufactured furniture and other articles of merchandise.
