The bill of complaint in this cause was filed to restrain the defendant from backing water, by means of a dam, across the St. Joseph river at Constantine, upon the property of the complainant at Three Rivers.
The bill states: That complainant was incorporated under the laws of this State -in June, 1882, for the purpose, among other things, of manufacturing cars and railway supplies at Three Rivers, and that it was authorized to acquire, own, and operate water power for its corporate purposes.
