MEMORANDUM
MERHIGE, Senior District Judge.
This matter comes before the Court on defendant’s motion for summary judgment. Defendant in this action is the American Tobacco Company (“ATC”). Plaintiff is Ginger Mannell. On April 22, 1994, plaintiff filed this action alleging: (1) harassment in violation of the Americans with Disabilities Act of 1990 (“ADA”), 42 U.S.C. § 12101 et seq., (2) discharge in violation of the ADA, (3) discharge in violation of the Employee Retirement Income Security Act of 1974, (“ERISA”), 29 U.S.C. §§ 1001 et seq., (4) wrongful discharge against Virginia public policy,…
