The plaintiff, a twenty-eight year old male, commenced this action to recover damages for his personal injuries proximately caused by the defendant’s failure to maintain and repair a public sidewalk under its control. At the time of trial, the plaintiff withdrew the second count of his complaint, sounding in nuisance.
