The plaintiff brought this action to recover damages from the town of Portland, or in the alternative, the state highway commissioner, for injuries sustained in a fall allegedly caused by an accumulation of snow and ice. At the conclusion of the evidence, both defendants made motions for directed verdicts. The court granted the motion of the town of Portland, but denied that of the state highway commissioner.
