This cause comes before the Court as a civil action against the United States, filed pursuant to provisions of the Federal Tort Claims Act,1 arising out of a *758collision, which occurred in the Eastern District of North Carolina, between an automobile owned and operated by a Marine sergeant, and plaintiff’s bridge.
