MEMORANDUM OPINION AND ORDER

LARKINS, District Judge:

This cause comes before this Court as a civil action against the United States, filed pursuant to the Federal Tort Claims Act, Title 28 U.S.C. Section 1346(b), arising out of a fatal automobile-pedestrian accident which occurred in the Eastern District of North Carolina between a privately owned vehicle operated by a member of the United States Coast Guard and Plaintiffs’ intestates.
