This is an appeal from a judgment rendered against defendants, Lipsey, Inc. and R. L. Lipsey, individually (Lipsey), in a suit for breach of an alleged oral joint venture agreement. This is the second appeal in the case, the first having been taken to the 1st Court of Civil Appeals from a summary judgment granted in favor of defendants. Panama-Williams, Inc. v. Lipsey, 576 S.W.2d 426 (Tex.Civ.App.—Houston [1st Dist.] 1978, writ ref’d n. r. e.).
