These Appeals involve a single question, and will therefore be disposed of together. The State of Indiana, oh the relation of the Railroad Commission of In*140diana, has appealed in each of said eases from a judgment which followed the sustaining of a demurrer to the relator’s petition and the alternative writ which issued thereon.
