MEMORANDUM AND ORDER

PHILLIPS, United States Magistrate Judge.

Defendant has moved this court pursuant to Fed.R.Civ.P. 50 and 59 for judgment notwithstanding the verdict, or in the alternative, for alteration or amendment of the judgment, a new trial, or a remittitur [Doc. 53]. Plaintiff has responded [Doc. 56].

The jury in this matter awarded plaintiff $70,000.00 for compensatory damages and $250,000.00 for punitive damages. Additionally, the jury indicated that plaintiff was to receive the cost of his legal fees [Doe. 52]. Rule 50 of the Federal Rules of Civil Procedure provides in part as…
