The above-entitled cause is now being determined as an error proceeding by reason of defendants’ appeal on questions of law from the judgment of the Court of Common Pleas of Franklin County, Ohio.

Prior to February 1, 1937, the plaintiff, Leon K. Rowley, was a Civil Service employee in the office of the Auditor of State as assistant examiner, Grade 1, Rate C, in the permanent classified Civil Service.
