OPINION AND ORDER

LEISURE, District Judge.

Plaintiff Gibson Tex, Inc. (“Gibson”) brings this action for copyright infringement pursuant to the Copyright Act of 1976, Title 17, United States Code (“U.S.C.”), Sections 101-1010, against defendants Sears Roebuck & Co. (“Sears”) and L.A. Intimates (“LAI”), a division of Kellwood Company, Inc. Pursuant to Rule 56 of the Federal Rules of Civil Procedure, Sears and LAI move for summary judgment.
