Plaintiff The Jewish Sephardic Yellow Pages, Ltd. (“JSYP”) sues defendants DAG Media, Inc. (“DAG”) and its president and CEO Assaf Ran under the Lan-ham Act and New York state law for infringement of the unregistered trademark “Kosher Yellow Pages.” Defendants now seek summary judgment on plaintiffs federal infringement claim, alleging that the mark is ineligible for trademark protection.
