This suit was • instituted in June, 1912, by appellant, under the name of the P. W. Cook Brewing Company, an Indiana corporation, with its domicile in Evansville, that state, against Samuel D. Page, W. S. Rankin, and Lloyd Wade, to recover the sum of $2,564.80, which it was alleged that Page owed for beer shipped to him by appellant. It was alleged that in 1925 the name of appellant was so changed as to omit the word “Brewing,” possibly in deference to the Eighteenth Amendment to the Constitution, and the Volstead Act (U. S.
