MEMORANDUM OPINION AND ORDER

THIS MATTER comes before the Court on the Motion for Summary Judgment by Plaintiff Certain Underwriters at Lloyd’s, London, filed August 23, 2006 (Doc. 74)(“Underwriters’ Summary Judgment Motion”).
