We granted the State’s motion for rehearing en banc. The case was reargued on November 18, 2004. On December 16, 2005, we withdrew our opinion and judgment of August 31, 2004. We substitute the following.

Appellant Jeffrey Michael St. George, Jr. was charged with the offenses of possession of marijuana and failure to identify as a fugitive. Appellant filed two motions to suppress, which were denied following a hearing. Appellant subsequently pleaded guilty to both charges and received deferred adjudication community supervision.
