ORDER

ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

WHITE, Senior Judge.

In this military pay case, the defendant has filed a motion entitled “Defendant’s Motion to Dismiss for Lack of Jurisdiction or in the Alternative, for Summary Judgment,” the plaintiff has responded to the motion, and the defendant has replied to the response. As both the defendant and *655the plaintiff have submitted documents of an evidentiary nature for the consideration of the court, the pending motion will be treated as one for summary judgment.
