OPINION

MARGOLIS, Judge.

Plaintiff brings this military pay case on appeal from a decision of the Army Board for Correction of Military Records (ABCMR). Plaintiff seeks back pay for the period from 1974 through 1987 in the amount of approximately $175,000. Plaintiff also seeks declaratory relief, equitable relief, and punitive damages. The case now comes before the court on defendant’s motion to dismiss and plaintiff’s motion for summary judgment.
