The complaint of the appellee, who was the plaintiff below, alleges that Moses C. Witherspoon and wife executed to one Gordon B. Bingham, Richard J. Coleman, and the appellee, a mortgage upon certain real estate therein described ; that the mortgage was executed to secure a promissory note for $986.25, executed to Bingham by the mortgagor, Moses C. Witherspoon, and also to indemnify the' said Richard J.
