Plaintiff-Appellant Kevin McCay appeals from the district court’s order granting summary judgment in favor of his former employer, Drummond Company, Inc. In his complaint, which Drummond had removed to federal court pursuant to the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1132(a)(1)(B), McCay challenged Drum-mond’s denial of his application for a disability retirement pension, alleging that he subsequently received a favorable award of Social Security benefits, and that Drummond was under a continuing duty to consider this new evidence of disability.
