This action was brought by the appellant to recover $7,500 damages alleged to have resulted from the defendant, who is respondent here and who is state game warden, freeing and turning 750,000 fish out of ponds alleged to belong to the appellant.

It is alleged in the complaint that the appellant is the owner of, and in the possession of, the S. W. % of section 33, Twp. 16 N., Range 43 E., B. M., in Fremont county; that the plaintiff did between the year 1892 and the year 1904 construct four artificial fish ponds on said land, and did supply said ponds with water from a certain spring situated…
