{¶ 1} Appellant, Thomas Aber, appeals from the decision of the Summit County Court of Common Pleas. This court reverses and remands for proceedings consistent with this opinion.

{¶ 2} On August 6, 2005, Aber was riding on a tube connected to a rope that was pulled by a boat. Aber was riding the tube with another individual, Dan Charek. Appellee, Richard Zurz, was operating the boat in Portage Lakes in southern Summit County. The boat was traveling in the designated water ski zone.
