This v/as a suit by the appellee against the appellants, for the collection of a promissory note executed by the appellant Copenrath and one Albert Hickman, since de*19ceased, to the appellee’s order, and for the foreclosure of a certain mortgage on real estate in Benton county, Indiana, executed by said Hickman, then in life, and his wife to the appellee.
