In an action for personal injuries brought against the City of Seattle and Daviscourt Construction Company based upon the attractive nuisance theory, the City and Daviscourt appeal the granting of a new trial following a jury verdict in their favor. We hold the trial court erred in granting a new trial and thus reinstate the jury verdict.

In 1975, Gasworks Park in Seattle was under construction. A permanent structure in the park was a group of tanks and towers utilized during the site's industrial era. A cyclone fence surrounded the park area, "Keep Out" signs were posted, and…
