THE COURT.

This is a proceeding to review the action of the board of governors of The State Bar recommending that the petitioner be disbarred.

The board found the petitioner guilty of misappropriation of funds entrusted to him as trustee and while acting in the dual capacity of attorney and trustee for Mary Cynthia Gesford Lott. The petition is based mainly on the contention that the evidence before the board is wholly insufficient to support the findings and conclusion of the board. Preliminarily certain other contentions may be disposed of briefly.
